Acceptance of Terms
By using Arrowine, Inc. (hereinafter “Arrowine.com) you are subject to the following Terms of Service (“ TOS “) which may be updated by us from time to time without notice.
You have connected to the Arrowine.com website. In doing so, you agree that you accept these General Terms and Conditions and further that you agree to be bound by these General Terms and Conditions. These General Terms and Conditions are applicable to all orders placed through Arrowine.com. All business transacted with Arrowine.com will be governed exclusively by these General Terms and Conditions.
If you do not agree to the terms, you are not authorized to use this site.
Electronic Communications
When you visit our Site, purchase products or services through the Site, or instigate contact with our customer service department, you are communicating with us electronically. We will also communicate with you via email or by posting notices on and updates to the Site. By using the Site, you hereby agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Account Maintenance
By using this site, you represent that you will be responsible for maintaining your account and password and for restricting access to your computer. You also agree to be responsible for any and all activities that occur under your password or your account. Arrowine will not be responsible for any loss or damage arising from your failure to comply with your responsibilities and obligations under these Terms and Conditions. To purchase any products or use the services on this Site, you must open an account with us and/or provide the required information to us. By entering any information on this Site, you represent and warrant that: (i) you are at least 21 years of age; (ii) you are using your actual identity; (iii) you have provided only true, accurate, current and complete information; and (iv) you will maintain and promptly update the information that you provide to keep it true, accurate, current and complete.
Termination
If you wish to cancel a username or password, or if you become aware of any loss, theft or unauthorized use of a username or password, you must notify us immediately. We reserve the right to delete or change any username or password at any time and for any reason. We may suspend or terminate your account or your use of our Site at any time, for any reason or for no reason at all. You are personally liable for any orders that you place or charges that you incur prior to termination. We reserve the right to change, suspend, or discontinue all or any aspects of this Site at any time without prior notice.
Product Description
Arrowine.com attempts to be as accurate as possible with our product descriptions. However, Arrowine does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current or error-free. If a product offered is not as described, your sole remedy is to return it in unused condition. PRICES AND AVAILABILITY OF THE PRODUCTS AND SERVICES LISTED ON OUR SITES ARE SUBJECT TO CHANGE WITHOUT NOTICE. The listing, description of, or reference to, a product or service on this Site does not imply that the product or service is presently available All orders of products or services are subject to prevailing law, including, as appropriate, export and import regulations and boycotting restrictions, if any imposed by governing bodies having jurisdiction over such orders, products or services.
Availability and Pricing:
Our cheeses are natural products and may vary slightly in appearance, color or shape from the images displayed on the website. We make every effort to ensure that our products are fresh and in the proper physical condition for shipment. Please understand that many of our cheeses are cut from much larger natural wheels or pieces and some of the product images displayed on the website are of the wheels or larger pieces and are used only to better display the item.
These artisanal cheeses are of limited availability and often supplied to us in irregular quantities and delivery cycles. Despite our best efforts, occasionally some products will not be available between the placing of your order and the expected ship date. Should this occur, we will contact you by email prior to shipment to discuss what alternatives are available. If we are unable to contact you prior to shipment, we will ship the in-stock products and refund the cost of the missing items and the related shipping charges. Should you so desire, we can add you to the "wait list" to send the product as soon as it is back in stock.
We will always do our best to honor the prices that show on our website. But please be advised that prices are subject to change without notice, and we reserve the right to correct pricing errors.
We guarantee that the prices displaced during checkout will be the price charged for each item regardless of whether the sale or special price expires before the order is shipped. Any sale or special pricing prior to checkout is only applicable during the period of the sale or special pricing, regardless of whether the item is in the shopping cart or wish list.
We reserve the right to refuse any order or to refuse to ship to any country or to refuse to accept payments from any Customer at our discretion.
Processing time:
Order processing time is contingent upon credit card authorization screening, and does not include weekends or holidays.
Returns:
We want you to be pleased with our products and our service. We guarantee that our products will be of good quality and in good physical condition when shipped. Orders cannot be returned unless the product is incorrect or tainted. You must inform us within 24 hours of delivery of the item(s). Please contact us at 703-525-0990 during business hours.
Out of stock items:
Though we continually monitor inventory to ensure product availability, there are times when products may be out of stock. If that occurs, representatives are available to suggest comparable substitutions. In cases where a substitution is necessary, we will email you before shipping and provide the option to select other items. If you decide not to make a substitution, we will ship available items minus the out of stock item(s) or cancel the order, if you prefer to do so. Your credit card will not be charged until we ship your order, and you will not be charged for out-of-stock items.
Shipping, Customs and Taxes:
We UPS for most shipments. The choice of shipment method is yours, and the shipping costs are calculated not by Arrowine but by the respective couriers. Couriers deliver during the working week, Monday through Friday, excluding applicable holidays and weekends. If you desire Saturday delivery within the United States please contact us for the extra costs that the carrier will charge for Saturday delivery.
Any damage to the order while in transit is the responsibility of the courier and any claim for damage must be filed with the courier per the courier’s standard terms and conditions, Arrowine will not be liable for damages or loss during transit. If the Customer is not present to receive the order when delivered by the courier, it is the Customer’s sole responsibility to make arrangements with the courier to reschedule the delivery. Arrowine will not be liable for any loss, damage or deterioration of the products that may occur due to a delayed or rescheduled delivery. Customs duties as well as to pay, or have paid, directly to the carrier any additional amount that might arise due to custom duties, value added tax or other taxes due upon import into the country where the Products are delivered. Estimated shipping times and shipping costs are based on the products selected, and will be determined at checkout. Shipping costs for orders from Arrowine are available at checkout. Deliveries will be made to the address specified on the order. Please make that selection carefully.
The Customer further agrees that all his or her orders are for his or her personal consumption or for the personal consumption of any other person to whom the Products are being sent at the Customer’s request. In the latter case, the Customer, on behalf of such third party, accepts these General Terms and Conditions.
Indemnity:
You agree to indemnify and hold Arrowine and its officers, agents, employees, representatives or other partners, and employees, harmless from any claims, losses, actions, damages, liabilities and expenses, including reasonable attorneys’ fees, made by any third party due to or arising out of your content, your use of the Service, your violation of the TOS, or our violation of any rights of another.

Arrowine respects the intellectual property rights of others and we ask users to do the same. Except as expressly authorized by Arrowine in whole or in part, Arrowine site and all its contents are copyrighted materials, protected by U.S. and international copyright laws. The compilation of content on our web site is the exclusive property of Arrowine and may not be used for any other purpose other than as set forth on the site. The services and information provided herein are solely for your own private use. You are only permitted to use Arrowine site as expressly authorized. Nothing contained herein transfers any express or implied right, title or interest in this web site to you. All content included on this site, such as text, graphics, logos, button icons, images, video clips, and other content is the property of Arrowine or its content suppliers and protected by United States and international copyright laws. All other trademarks not owned by Arrowine that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Arrowine.
Invalidity, Force Majeure Applicable law Competent Courts.
If any one of the clauses of these General Terms and Conditions are, for Invalidity – Force Majeure – Applicable law – Competent Courts
If any one of the clauses of these General Terms and Conditions are for whatever reason, declared invalid or invalidated for any reason, this will not affect the application or the validity of the other clauses. The Clause declared invalid, or invalidated, will be replaced by the disposition closest to that clause. Neither Arrowine nor the Customer will be held liable for any failure to perform their obligations as a result of a force majeure beyond their control, including but not limited to the following: war, riot, insurrection, interruption of transport systems, problems relating to export and import, strikes, lock-out, shortage of Products, fire, earthquakes, storms or floods.
Governing Law:
The terms and conditions contained herein and the agreement created thereby shall be governed by and interpreted according to the laws of the Commonwealth of Virginia without applying conflict of law principles. You expressly agree through your use of the site to be subject to jurisdiction and venue in the Commonwealth of Virginia and to have any adjudication related to this site resolved in the federal court of the District Court of Eastern District of Virginia or any state courts of the Commonwealth of Virginia. If any provisions of this agreement, terms or conditions is unlawful, void or unenforceable, it will not affect the validity and enforceability of any remaining provision.
No Warranties:
Arrowine does not warrant that Arrowine website will operate error-free or that Arrowine website and its server are free of computer viruses and other harmful components. If your use of the Arrowine site results in the need for services or replacing equipment or data, Arrowine is not responsible for those costs.
You assume total responsibilty and risk for use of the Arrowine site which is provided “as is” to the greatest extent permitted by law. Arrowine makes no warranties, exress or implied, and specifically disclaims any warranty or merchantability of fitness for a particular purpose, title, accuracy or non-infringement or any waranty arising by usage of trade, course of dealing or course of performance to the greatest extent permitted by law. In no event shall Arrowine be liable for any direct or indirect, consequential, punitive or special damages, including without limitation, damages for lost profits, business interruption or loss of information, related to the Arrowine site or arising out of this agreement, even if Arrowine has been advised of a possibility of such damages for the purposes of this paragraph. Any reference to Arrowine shall be deemed to include Arrowine’s employees, owners, directors, officers, licensees, representatives and subcontractors, suppliers and distributors.
Because some states may not permit all the exclusion or the limitation of the foregoing warranties, liaility for consequential or incidental damages, or other claims and damages, the above limitations may not apply to you. In the event applicable state or federal law does not allow the complete exclusion or limitation of liability of claims and damages as set forth in this agreement, Arrowine’s liability is limited to the greatest extent such exclusion and/or limitation is permitted by law.
